Terms & Conditions

These Terms & Conditions (“Terms”) apply to the purchase, access, streaming, downloading and use of audiobooks and related digital content offered through the FAB Audiobook Store at fabaudiobookstore.com (“Store”).
The Store is operated by First Audiobooks Limited, a company incorporated in Gibraltar under company number 124089, whose registered office is at Suite 4.3.02, Eurotowers, Gibraltar, GX11 1AA and whose address for service is info@firstaudiobooks.com (“First Audiobooks”, “FAB”, “we”, “us” or “our”).
By purchasing, downloading, streaming or otherwise accessing an audiobook from the Store, you agree to these Terms.
1. Our audiobooks
The Store specialises in immersive audiobooks. Depending on the title, an audiobook may contain multiple character voices; artificial-intelligence-generated or cloned voices; music; ambient audio; sound effects; synthetic or digitally manipulated audio; and other production elements intended to create an immersive listening experience.
The product page for each audiobook provides information about that title, including its author, price, approximate or stated runtime, available sample and other relevant particulars.
2. AI-generated and manipulated audio
Some or all voices, music, sound effects or other elements in an audiobook may have been generated, reproduced, modified or manipulated using artificial intelligence.
Where applicable, FAB provides an AI transparency notice on the relevant audiobook page.
Such notices are intended, among other things, to support compliance with the transparency requirements of Article 50 of Regulation (EU) 2024/1689, the European Union Artificial Intelligence Act.
For future productions, FAB may also incorporate appropriate AI-transparency information into the audiobook itself and may use or preserve technical or machine-readable methods of identifying AI-generated content where appropriate or required.
A reference to AI-generated content does not mean that the audiobook was produced without human involvement. FAB may undertake human selection, direction, editing, mixing, quality control and other production work.
3. Paddle and payment transactions
Where a purchase is processed through Paddle, Paddle acts as the authorised reseller and Merchant of Record for the transaction.
- payment is made to Paddle;
- Paddle processes the transaction and applicable payment taxes;
- the transaction is also subject to Paddle’s applicable Buyer Terms and Refund Policy; and
- the audiobook itself is supplied or licensed for use subject to these FAB Terms.
Nothing in these Terms is intended to override any mandatory rights contained in Paddle’s Buyer Terms or applicable consumer law.
4. Prices
Prices displayed in the Store are shown in the currency stated on the relevant product page or checkout.
Unless otherwise stated, the price displayed for an audiobook is the price for a personal digital licence to access and use that audiobook in accordance with these Terms.
Taxes may be added, included or otherwise dealt with by the Merchant of Record according to the purchaser’s location and applicable law.
5. Digital delivery
Audiobooks may be delivered through BookFunnel or another digital-delivery service selected by FAB.
You are responsible for providing a valid email address and for ensuring that messages relating to your purchase are not prevented by spam filters, mailbox restrictions or incorrect account information.
You should retain your purchase confirmation and any delivery instructions sent to you.
6. Licence to the purchaser
Your purchase does not transfer copyright or ownership of the audiobook to you.
Subject to these Terms, you receive a personal, non-exclusive, non-transferable licence to download, store and listen to the audiobook for your own private use.
Unless expressly permitted by law, you must not:
- resell or redistribute the audiobook;
- upload it to public or shared file-storage services;
- make it available to other people outside ordinary private household use;
- broadcast or publicly perform it;
- copy or commercially exploit it;
- remove copyright, AI-transparency, watermarking or rights-management information;
- extract voices for voice cloning or impersonation;
- use the audiobook or its component audio to train an artificial-intelligence model; or
- use the audiobook for automated text, voice, music or data extraction for commercial purposes without written permission.
7. Samples
Samples made available through the Store are provided solely to help customers assess an audiobook before purchase.
Samples remain protected by copyright and may not be copied, downloaded, redistributed or commercially exploited except where expressly permitted.
The availability of a sample does not create an obligation to provide the complete audiobook free of charge.
8. Immersive audio and safety
Immersive audiobooks may contain sudden, loud, unexpected or highly realistic sounds.
These may include, for example, vehicle noises, horns, crashes, sirens, alarms, explosions, gunfire, shouting, distress sounds, music changes and other effects designed to form part of the dramatic production.
You are responsible for choosing an appropriate listening environment and volume.
If you listen while driving, cycling, operating machinery or carrying out any activity requiring attention to your surroundings, you are responsible for ensuring that:
- doing so is lawful;
- your use of headphones, speakers or audio equipment is lawful and safe;
- the volume does not prevent you from hearing relevant external sounds; and
- the audiobook does not distract you from the safe performance of that activity.
You should pause or stop playback if any part of an audiobook distracts, startles or adversely affects you.
Nothing in these Terms is intended to exclude liability that cannot lawfully be excluded.
9. Content and suitability
Audiobooks are creative works and may contain material that some listeners find disturbing, frightening, offensive or unsuitable.
Depending on the title, content may include violence, death, crime, warfare, political themes, sexual references, strong language, frightening situations or other mature subject matter.
Product descriptions and any content information are intended as general guidance only and are not guaranteed to identify every potentially sensitive scene, sound or subject.
Unless a title is specifically identified as being intended for children, FAB does not represent that it is suitable for children.
A parent, guardian or supervising adult is responsible for deciding whether an audiobook is appropriate for a child in their care.
Individual reactions to fictional material, voices, music and sound effects vary. FAB does not guarantee that any audiobook will be emotionally or physically comfortable for every listener.
10. Fictional content
Unless expressly stated otherwise, FAB audiobooks are works of fiction.
Characters, dialogue, organisations, events and situations may be fictional or dramatised.
References to real places, institutions, political events, historical events, companies or public figures do not imply their participation in, approval of or endorsement of the audiobook.
11. Technical requirements
You are responsible for using a device, internet connection and audio system capable of accessing the formats through which the audiobook is supplied.
We do not guarantee compatibility with every device, operating system, application, browser, vehicle audio system or third-party platform.
If you experience a genuine technical delivery problem, please contact us so that we can attempt to resolve it.
12. Cancellation, withdrawal and refunds
Digital-content purchases are subject to the refund and cancellation arrangements presented at checkout by Paddle or any other Merchant of Record used for the transaction, together with any mandatory rights arising under applicable consumer law.
In jurisdictions providing a statutory cancellation or withdrawal period for digital content, you may be asked to consent to immediate supply of the audiobook and to acknowledge that, where permitted by law, your statutory right to withdraw may end once downloading, streaming or other supply of the digital content has begun.
Nothing in these Terms limits any refund, repair, replacement or other remedy that applicable law requires us or the Merchant of Record to provide.
13. Intellectual property
Copyright and other intellectual-property rights in each audiobook remain with FAB, the author, rights holder or relevant licensor as applicable.
The FAB name, branding, website design and associated materials are protected by applicable intellectual-property law.
No rights are granted except the limited personal-use licence expressly stated in these Terms.
14. Availability and changes
We may add, withdraw or change products offered through the Store.
We may correct typographical errors, pricing errors, inaccurate descriptions or technical information.
We may also replace an audiobook file where necessary to correct technical faults, improve compatibility or address legal, rights or compliance issues.
A change will not remove statutory rights that have already arisen from a completed purchase.
15. Third-party services
The Store may rely on services provided by third parties, including Paddle, BookFunnel, hosting providers and other technology providers.
Those services may also be subject to their own terms and privacy policies.
We are not responsible for failures caused solely by a third-party service where the failure is outside our reasonable control, but this does not affect any responsibility that applicable law requires us to retain.
16. Consumer rights
Nothing in these Terms excludes, restricts or attempts to waive a right or remedy that applicable consumer law says cannot lawfully be excluded or restricted.
If any provision of these Terms conflicts with a mandatory consumer-protection law applicable to you, that mandatory law prevails to the extent of the conflict.
17. Limitation of liability
Nothing in these Terms excludes or limits liability for:
- fraud or fraudulent misrepresentation;
- death or personal injury caused by negligence where such liability cannot lawfully be excluded or restricted;
- wilful misconduct or gross negligence to the extent applicable law prohibits its exclusion or limitation; or
- any other liability or statutory consumer remedy which cannot lawfully be excluded or limited.
Subject to the paragraph above, and to the fullest extent permitted by applicable law, FAB will not be liable for:
- losses that were not reasonably foreseeable when the relevant contract was made;
- indirect, incidental, special or consequential losses;
- loss of income, business, profit, opportunity, goodwill or anticipated savings;
- losses resulting from use of an audiobook in an unsafe or unlawful environment;
- loss or damage resulting from listening at an unsafe volume;
- losses arising from a listener continuing playback after becoming aware that the content is distracting or adversely affecting them;
- losses arising from a parent or guardian permitting a child to listen to content that was not expressly represented as suitable for that child; or
- loss resulting from your breach of these Terms or failure to follow a clear safety warning.
Subject always to liabilities and remedies which cannot lawfully be limited, FAB’s total aggregate liability arising out of or in connection with any one audiobook, whether in contract, tort (including negligence), misrepresentation, restitution, statute or otherwise, will not exceed twice the amount actually paid for that audiobook.
For example, where the price actually paid for an audiobook is US$9.99, the contractual liability cap under this provision is US$19.98, except where applicable law does not permit that liability to be capped.
This limitation applies to the maximum extent permitted by the law applicable to the particular purchaser and claim.
18. No business losses for consumer purchases
The Store is intended primarily for personal consumer purchases.
If you nevertheless use an audiobook for business or commercial purposes, then, to the fullest extent permitted by law, FAB is not responsible for loss of business, profits, revenue, contracts, commercial opportunities or business interruption arising from that use.
19. Privacy
Personal information is handled in accordance with the FAB Audiobook Store Privacy Policy and, where relevant, the privacy policies of Paddle, BookFunnel and other providers involved in payment and delivery.
20. Changes to these Terms
We may update these Terms from time to time, including to reflect changes in law, technology, payment arrangements or the operation of the Store.
The Terms applicable to a purchase will ordinarily be the version in force when that purchase was made, except where a later change is required by law or is expressly agreed with you.
21. Severability
Each provision of these Terms operates separately.
If a court or competent authority decides that any provision, or part of a provision, is unlawful, invalid or unenforceable, that provision will apply only to the extent that it can lawfully do so, and the remaining provisions will continue in effect.
22. No waiver
If FAB does not immediately enforce a provision of these Terms, that does not mean FAB has waived the right to enforce it later.
23. Governing law and jurisdiction
Subject to any mandatory consumer-protection law that applies to you, these Terms and the relationship between you and First Audiobooks Limited are governed by the laws of Gibraltar.
Nothing in this clause deprives a consumer of mandatory protections available under the law of the country in which that consumer habitually resides where those protections apply irrespective of the chosen governing law.
Nothing in these Terms prevents a consumer from bringing proceedings in a court which applicable mandatory law entitles that consumer to use.
For purchasers acting wholly in the course of a trade or business, the courts of Gibraltar shall have exclusive jurisdiction except where FAB agrees otherwise in writing.

If you have a problem with an audiobook, please contact us first at info@firstaudiobooks.com so that we have an opportunity to investigate and resolve the matter.
For issues concerning payment processing, billing, taxation or a Paddle transaction, you may also have rights to contact Paddle directly under its Buyer Terms.
